Event Liability Waiver & Release of Liability

Effective Date: 27th March 2026

By registering for and participating in any event, race, training session, or activity organized by Kenyan Diaspora Athletics Club (KDAC), you acknowledge and agree to the following terms and conditions.

1. Assumption of Risk

I understand that participation in athletic activities, including running, training, and competitive events, involves inherent risks. These risks may include, but are not limited to, physical injury, illness, falls, collisions, weather-related conditions, equipment failure, and other unforeseen hazards.

I voluntarily assume full responsibility for any risks, injuries, damages, or losses that may occur as a result of my participation.

2. Health and Fitness Declaration

I confirm that I am physically fit and medically able to participate in the event. I have not been advised otherwise by a qualified medical professional.

I understand that it is my responsibility to consult with a physician prior to participating if I have any concerns regarding my health or fitness.

3. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge Kenyan Diaspora Athletics Club (KDAC), its directors, officers, members, volunteers, sponsors, partners, and affiliates from any and all liability, claims, demands, or causes of action arising from my participation.

This includes, but is not limited to, claims related to personal injury, property damage, loss, or death.

4. Event Rules and Compliance

I agree to follow all rules, instructions, and safety guidelines provided by KDAC, event organizers, and officials.

I understand that failure to comply may result in my removal from the event without refund.

5. Emergency Medical Treatment

I authorize KDAC and its representatives to obtain medical treatment for me in the event of an emergency.

I understand that I am responsible for any medical expenses incurred.

6. Media Release

I grant KDAC permission to photograph, record, and use my image, likeness, and voice in any media, including photos, videos, and livestreams, for promotional, educational, and community purposes without compensation.

7. Personal Responsibility

I understand that I am responsible for my own safety and conduct during the event. I agree not to participate under the influence of alcohol, drugs, or any condition that may impair my ability to safely participate.

8. Indemnification

I agree to indemnify and hold harmless KDAC and its representatives from any claims, damages, or liabilities arising from my participation or my actions during the event.

9. Minors

If the participant is under the age of 18, a parent or legal guardian must agree to this waiver on their behalf and assumes full responsibility for the minor’s participation.

10. Agreement and Acknowledgment

By registering for this event, I acknowledge that I have read, understood, and voluntarily agree to this waiver and release of liability.

I understand that I am giving up certain legal rights, including the right to sue.
